Telemarketing Compliance & Do Not Call Policy

This is our written telemarketing policy regarding compliance with applicable telemarketing laws, including, without limitation, the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and similar state laws. Our outbound calling program is business-to-business only. This policy applies to every employee, contractor, and representative who places outbound telephone calls on our behalf, and to any vendor or system used to place those calls.
1. Our Commitment
We sell to businesses, not consumers. Every list we build and every call we place is directed at a business, about services for that business. We do not market to consumers, and nothing we sell is for personal, family, or household use.
We conduct all outbound calling in compliance with the TCPA (47 U.S.C. § 227 and its implementing rules), the TSR (16 C.F.R. Part 310), and applicable state telemarketing and telephone-solicitation laws. Where federal and state requirements differ, we follow the stricter rule. Genuine business-to-business calls are exempt under 16 C.F.R. § 310.6(b)(7) from many consumer-telemarketing rules, including the TSR's Do Not Call provisions. That exemption covers much of what we do, but we do not build our program on it: we run every protection described below on every call, because small-business owners often answer on personal mobile numbers and some states apply their do-not-call rules to business-to-business calls. In particular, we treat the entity-specific Do Not Call rules as binding on every call we place, without relying on any business-to-business exemption.
2. Written Do Not Call Policy
This section constitutes our written Do Not Call policy, maintained and made available in accordance with 16 C.F.R. § 310.4(b)(1)(iii)(A) and 47 C.F.R. § 64.1200(d). A copy of this policy is available free of charge to anyone who requests it, by emailing [email protected] or calling (800) 422-5034.
- Internal Do Not Call list. We maintain a company-specific Do Not Call list inside our calling system. When any person asks not to be called again, in any words, on any call, the request is honored on the spot: the number is recorded on our internal list at the time of the request and no further outbound sales calls are placed to it.
- Permanence. Internal Do Not Call entries are kept permanently and are never deleted as part of routine data cleanup. Our records retain Do Not Call requests well beyond the five-year minimum required by law.
- System enforcement. Our calling system blocks numbers on our internal Do Not Call list automatically. A number on the list cannot be served to a caller, and outcomes cannot be logged against it. Where two businesses share one telephone number, a Do Not Call request on that number blocks calls to both.
- National and state Do Not Call screening. Business-to-business calls are generally exempt from National Do Not Call Registry screening, but the exemption narrows exactly where it matters: the FCC presumes a registered mobile number belongs to a residential subscriber, courts have treated registered mobiles as residential even when they are also used for business, and some states (including Florida, Maryland, Oklahoma, and Washington) apply their do-not-call rules to business-to-business calls. So we screen anyway. A cold-outbound number is not released to a caller until a fresh screening record confirms that the National Do Not Call Registry and the applicable state registry were checked. If the required screening is missing, expired, unavailable, or returns a match, our system holds the number and does not permit a call.
- Personnel obligations. Everyone who dials for us is trained on this policy before placing a first call, including how to recognize and record a Do Not Call request. Failure to honor a request is grounds for discipline up to termination.
3. Calling Hours
The federal calling-hour rule protects residential telephone subscribers, and small-business owners often answer on personal numbers, so we treat it as binding on every call we place. We place outbound sales calls only within legally permissible hours in the recipient's local time zone (no earlier than 8:00 AM and no later than 9:00 PM local time under federal law, with stricter state windows honored where they apply). Our initial operating window is narrower: weekdays from 11:00 AM through 7:59 PM in the recipient's local time. States requiring controls that are not yet implemented remain disabled. The CRM fails closed outside the approved window: it will not serve a number for dialing and will not accept a call outcome logged outside the window, and the dialer receives numbers only from that gate.
4. Identification and Honest Dealing
- Our callers promptly identify themselves, identify GrowFasterSEO, and disclose that the purpose of the call is to sell our services.
- We provide a working callback number, (800) 422-5034, and transmit accurate caller ID information. Our first PhoneBurner outbound caller ID is (702) 941-3538. We do not spoof or misrepresent caller ID.
- We do not misrepresent who we are, what our services do, what they cost, or the terms of any offer. Pricing and material terms are stated before any payment is requested.
5. Dialing Practices
- Outbound calls are initiated by human agents. We do not deliver artificial-voice or prerecorded-voice sales messages to any telephone number without the prior express consent the law requires.
- Voicemail messages left on wireless numbers are spoken live by the calling agent, not prerecorded.
- We do not send marketing text messages without the prior express written consent required by law.
6. Call Recording and Monitoring
Outbound call recording is disabled for the initial launch. If recording or monitoring is enabled later, we will first implement and test the notice and consent workflow required by every applicable jurisdiction.
7. Training, Oversight, and Review
All calling personnel receive training on this policy and on applicable law before dialing and on an ongoing basis. Compliance is supervised, violations are corrected and disciplined, and this policy is reviewed and updated at least annually and whenever the law changes.
